Eminent Domain/Condemnation Proceedings
This area of the law deals with the government or some other entity that has the power to take your property for a necessary or public use. Eminent Domain refers to the right to take property, and Condemnation refers to the process used to exercise this right. The law requires the property owner be paid just compensation for their property based upon a sale of the property as if it occurred between a willing seller and willing buyer. This process starts as an administrative matter but can ultimately be determined in a court of law by a jury.
