Texas Criminal Law

There are two main types of crimes in Texas: misdemeanors and felonies. The main difference between the two offenses is that a misdemeanor is not as serious as a felony.

Misdemeanors can carry local or county jail sentences, as well as a fine. Additionally, they are punishable by a jail term of up to one year.

The following are the misdemeanor classes in Texas:

  • Class A misdemeanors – A conviction carries a maximum jail sentence of one year and/or a fine no more than $4,000.
  • Class B misdemeanors – A conviction carries a jail term of up to 180 days and/or a fine not exceeding $2,000.
  • Class C misdemeanors – A conviction carries no jail time and a fine of up to $500.

On the other hand, felonies are generally punishable by a state prison sentence of more than one year. A felony conviction can not only lead to harsher penalties, but also the loss of the right to own a gun, vote, and hold public office.

Felony classes in Texas include:

  • Capitol felonies – A conviction can result in life without parole or the death penalty.
  • First-degree felonies – A conviction can result in life imprisonment or a fine of up to $10,000.
  • Second-degree felonies – A conviction can result in a maximum 20-year prison term and a fine of up to $10,000.
  • Third-degree felonies – A conviction can result in a maximum 10-year prison sentence and a fine no more than $10,000.
  • State jail felonies – A conviction can result in a maximum two-year state jail term and a fine not exceeding $10,000.
